Marriage Contracts

When you enter into a marriage, you are entering into a legal relationship with your spouse and are automatically subject to legislation defining your rights and obligations. Marriage contracts expand upon and personalize these rights and obligations. They can address various aspects of the relationship, including division of assets and spousal support payments in the event of marital breakdown. Marriage contracts can be arranged before or during the marriage. Typically, however, such contracts are entered into before the marriage takes place.

To ensure that your rights are protected, it is important that contracts be properly drafted, as the law is very specific as to what constitutes a valid contract. It is essential that both parties to a marriage or cohabitation agreement obtain independent legal advice, or the agreement risks being invalidated.
