Uber Eats Quebec Service Fee Class Action

McKenzie Lake Lawyers LLP, along with Sylvestre Painchaud et Associés LLP, is pursuing a class action against Uber Technologies Inc., Uber Canada Inc., Uber Portier Canada Inc., and Uber Castor Canada Inc. (collectively, “Uber”), on behalf of all persons resident in Quebec who, on or after June 25, 2022, placed an order for delivery using the Uber Eats Platform and paid a Service Fee AND on behalf of all Class Members who, on or after June 25, 2022, were Uber One members.

The action alleges that in addition to the advertised Delivery Fee, Uber imposes additional fees, called “Service Fees,” solely on delivery orders, without disclosing them in a sufficiently clear and transparent manner during the ordering process. These fees are only revealed at the final payment stage, under the heading “Taxes & Other Fees,” which misleads consumers about the true cost of delivery. The action further alleges that Uber misrepresents the benefits of its “Uber One” subscription, particularly by indicating that it includes free delivery, while Uber continues to charge Uber One members Service Fees for their delivery orders.
