Roundup® Class Action

McKenzie Lake Lawyers LLP is working cooperatively with a national consortium of lawyers to pursue a class action lawsuit against Monsanto Canada ULC (now Bayer CropScience Inc), Monsanto Company, and Bayer Inc (the “Defendants”) on behalf of all individuals in Canada who (a) had “Significant Exposure” to Roundup® prior to December 8, 2023, and (b) were diagnosed with non-Hodgkin’s lymphoma after their Significant Exposure but before December 8, 2023.

The claim alleges that Significant Exposure to Roundup® products and their active ingredient, glyphosate, is associated with an increased risk of developing non-Hodgkin’s lymphoma. The claim further alleges (1) that the Defendants knew or ought to have known about this increased risk and distributed and sold Roundup® products anyway; (2) that the Defendants misrepresented the safety of their Roundup® products and their active ingredient, glyphosate, to consumers; and, (3) that the Defendants failed to properly, adequately and fairly warn consumers about this increased risk of developing non-Hodgkin’s lymphoma.

For the purposes of this lawsuit, “Roundup®” means any herbicide containing glyphosate that was made, marketed, sold or distributed by the Defendants, even if it was not marketed with the “Roundup®” brand name. It does not include “Roundup® Advanced” herbicides, which do not contain glyphosate.

Significant Exposure” means the application of glyphosate-based herbicides made, marketed, sold or distributed by the Defendants on more than two occasions in a 12-month period and more than 10 occasions in a lifetime.

Update (December 12, 2023):

We are pleased to announce that on December 8, 2023, the Ontario Superior Court of Justice certified this action as a class proceeding. This means that the Court has approved this lawsuit continuing as a group action as opposed to a series of individual actions.

Update (April 21, 2025):

The Court has now issued the certification order and the order approving the notice to Class Members advising them of the lawsuit’s certification as a class action and their rights and options.

You are a Class Member if you are:

  • an individual in Canada who (a) had Significant Exposure to Roundup® prior to December 8, 2023, and (b) was diagnosed with non-Hodgkin’s lymphoma after your Significant Exposure to Roundup® but before December 8, 2023 (“Non-Hodgkin’s Lymphoma Class Member”); or,
  • an individual in Canada who is the living spouse, child, grandchild, parent, grandparent, or sibling of a Non-Hodgkin’s Lymphoma Class Member (“Family Class Member”).

If you are a Class Member and you want to remain in the Class, you are automatically included and you do not need to do anything at this time. Please check this website regularly for important updates. You can also provide your email address to Class Counsel to be notified by email of important updates.

If you are a Class Member and you do not want to participate in the class action, you must take steps to remove yourself from the class action. This is called “opting out.” If you opt out, you will not be allowed to participate in the class action and you will not receive any compensation that results from the class action. You will, however, keep your right to sue the Defendants on your claims at your own expense.

To remove yourself from the class action (opt out), you must send a signed and completed Opt-Out Form to the Administrator on or before July 17, 2025. A copy of the Opt-Out Form can be obtained from the www.glyphosateclassaction.ca or by reaching out to the Administrator by email (info@glyphosateclassaction.ca).
