GFL Environmental Inc. – Individual Litigation
McKenzie Lake Lawyers LLP, in conjunction with Napoli Shkolnik Canada, has recently commenced multiple individual claims against GFL Environmental Inc., with respect an engineered non-hazardous waste landfill located in Stoney Creek, Ontario. The allegations in the Claims concern the landfill’s purportedly strong odours, which have been frequently described as resembling wet garbage, dead fish, cat urine, rotten eggs, and chemicals.
The Claims allege that the persistent and unpredictable nature of the odours have caused homeowners significant frustration, stress, anxiety, and loss of enjoyment of their home. The Claims further allege that some individuals have experienced physical symptoms as a result of the exposure to the odours, including, but not limited to, sore throats, headaches, nausea and dizziness. The claims further allege that as a result of the landfill that the property values of residences near the landfill are lower than they would otherwise be.
