Apple AI Misrepresentations Class Action

On May 21, 2026, McKenzie Lake Lawyers LLP, in conjunction with Hammerco Lawyers LLP in British Columbia, commenced a proposed class action against Apple Canada Inc. and Apple Inc. (collectively, “Apple”), on behalf of all persons in Canada (including their estates, executors, or personal representatives) who purchased or leased an iPhone 16, iPhone 16 Plus, iPhone 16 Pro, iPhone 16 Pro Max, iPhone 16e, iPhone 15 Pro, or iPhone 15 Pro Max smartphone between June 10, 2024 and March 29, 2026.

The proposed class action alleges that in the months leading up to and following the release of the iPhone 16 smartphone series, Apple made false, deceptive, and misleading representations regarding the artificial intelligence (“AI”) features, characteristics, and capabilities of the iPhone 16 smartphones and the iPhone 15 Pro and iPhone 15 Pro Max smartphones once updated to iOS 18. The proposed class action further alleges that Apple knowingly and intentionally made these false, deceptive, and misleading representations to induce consumers to purchase or lease the iPhone 16 series, iPhone 15 Pro, and iPhone 15 Pro Max smartphones at premium prices despite these smartphones not being as advertised and lagging behind competing products.
