Yasmin/YAZ Class Action

We are pleased to announce that a proposed Settlement has been reached in the Yasmin/YAZ Class Actions. The lawsuits allege that both Yasmin® and YAZ® are associated with an increased risk of suffering various types of blood clots and gallbladder disease, compared to other available oral contraceptives but that the warning given was that the risks were the same.  The claims further alleges that the increased risk was known to Bayer Inc., and they failed to timely or adequately communicate the risk information to consumers and the medical community. The Defendant denies these allegations, and the Court did not decide who was right, alternatively, the Parties have decided to settle the lawsuit.

Settlement Class or Settlement Class Members

  1. all persons resident in Canada who were prescribed and ingested Yasmin and/or YAZ between December 10, 2004 (in respect of Yasmin) or January 6, 2009 (in respect of YAZ) and:
  1. in the case of residents of Ontario and Québec, November 30, 2011; and
  2. in the case of all other Canadian residents (excluding Ontario and Québec), October 4, 2016

and who were subsequently diagnosed with arterial thromboembolism, venous thromboembolism, and/or gallbladder disease, excluding Opt Outs, all such persons being User Settlement Class Members; and

  1. all persons resident in Canada who, by virtue of a personal relationship to any one or more of the persons described in (a) above, has a Family Law Act Derivative Claim for damages, excluding any Opt Out or Provincial Health Insurer, all such persons being Family Settlement Class Members.

The Proposed Settlement

The proposed Settlement provides for the creation of a CAD $9,050,000.00 Settlement Fund that will be used, among other things, to pay the costs of notice and administration of the Settlement, the claims of Provincial Health Insurers, Class Counsel legal fees, and benefits for Approved Claimants who are part of the Settlement Class. The final value of benefits for each Approved Claimant will not be determined until all Claims are submitted and considered by the Claims Administrator.

The maximum allocation that an Approved Claimant* may receive is:

NOTE: At this time, there is no money available for Class Members. The claims process has not yet begun. If the proposed Settlement is approved, Class Members may make a Claim for compensation under the Settlement.

Settlement Approval Hearing(s)

The Courts will hold Settlement Approval Hearings on the dates listed below, to consider whether or not to approve the proposed Settlement, Class Counsel Fees and/or Honoraria.

  • November 14, 2025: Ontario Superior Court of Justice;
  • November 14, 2025: Superior Court of Québec; and
  • November 21, 2025: Court of King’s Bench for Saskatchewan.
  • If you support the proposed Settlement, Class Counsel Fees, and Honoraria, you do not have to do anything at this time. If the Court approves the Settlement and you are eligible, you will be able to submit a Claim for compensation. 
  • If you do not like the proposed Settlement and want to tell the Court why you do not like it, you can object to the proposed Settlement, Class Counsel Fees, and/or Honoraria. If you wish to object to the proposed Settlement, you must submit a written objection no later than 5:00pm Eastern Time on October 14, 2025.
