Professional Experience and Activities

Richard McLaren teaches bankruptcy and insolvency law; contracts; secured transactions; corporate finance; dispute resolution and case studies in business law at The University of Western Ontario Faculty of Law. He is Counsel with McKenzie Lake Lawyers LLP where he does appellate litigation and consultive trial work as well as legal opinions in the fields in which he teaches and has written books. Richard has 30 years of arbitration experience as a third party neutral in labour, commercial and sports arbitrations.

One area of Richard's experience is in arbitrating sports disputes. He was a salary arbitrator for the National Hockey League and the NHLPA for 7 years. Over the years he has arbitrated many other sports related disputes in Canada. This work was recognized by the Court of Arbitration for Sport in his election to the Court of which he has been an active member. CAS is the adjudication body for the International Olympic Committee. Has been an arbitrator at the Nagano (1998), Turino (2006) Winter Olympic Games and at the Sydney (2000) and Athens (2004) Summer Olympic as well as the Commonwealth Games (2002) and the World Cup of Soccer (2001).

In 2001, Richard was appointed as an arbitrator to the International Commission on Holocaust Era Insurance Claims. ICHEIC has initiated the process to resolve the unpaid insurance claims of Holocaust victims, survivors, their heirs and beneficiaries for life, education and dowry policies issued between 1920 and 1945. This appointment came about as a result of a review of profiles of 120 arbitrators from around the world from which thirty arbitrators were selected.

In 2000, he was nominated to be one of 12 on site arbitrators for the 2000 Summer Olympic Games in Sydney, Australia. During this time he was appointed by the United States Olympic Committee as Chair of the Independent International Commission looking into alleged doping cover-ups of the USA Track and Field (Report 2001).

From 1992 to 1998, Richard had appointments to the Bankruptcy and Insolvency Committee advising the Minister of Consumer and Corporate Affairs on the Bankruptcy and Insolvency Act; the Ministry of Consumer and Commercial Relations Personal Property Security Registration Branch's Senior Editorial Board on proposed amendments to The Business Corporations Act affecting the PPSA; Personal Property Security Law Committee, Business Law Section of the Canadian Bar Association (Ontario); co-Reporter for Canada on the American Law Institute NAFTA Insolvency Project Phases I and II.

Richard has been an editor of the Personal Property Security Act Cases (PPSAC) since 1977. He is the author of Canadian Commercial Reorganization: Preventing Bankruptcy (Canada Law Book, 1994); Innovative Dispute Resolutions: The Alternative!, (Carswell: 1994); Secured Transactions in Personal Property in Canada, (2 ed.), (Carswell: 1992). Annotated Ontario Personal Property Securities Act (2007). He is also the author of numerous articles, chapters in books and case comments.
